Two brothers and a young woman accused of attacking another man with a baseball bat in Monaghan Town have been sent forward for trial to Monaghan Circuit Court.
The three are facing a number of serious charges in relation to the incident that left the man fighting for his life in hospital.
Jason (25) and Stephen Maughan (24) of Mullaghmatt and Gortakeegan, Monaghan respectively and Molly Roberts (22), Lakeview, Enagh, Monaghan appeared before a sitting of Monaghan District Court charged with assault causing harm to a man in his 40s following an incident on the Park Road in Monaghan on January 14th of this year.
The three have been on bail since the incident first came in front of the courts at the start of the year.
The charges the Maughan brothers and Ms Roberts face has been upgraded to ones of assault causing serious harm from the initial assault causing harm charges.
All three a charged with charges that they did assault Declan Wallace causing them harm. Contrary to Section 3 (1) and 3(2) of the Non-Fatal Offences against the Person Act 1997 (as amended by Section 20 of the Criminal Justice (Miscellaneous Provisions Act 2023). The second charge is assault Causing Harm and Assault Causing Serious Harm in the course of a dispute produce in a manner likely unlawfully to intimidate another person an article capable of inflicting serious injury, to wit, Baseball bat. Contrary to section 11 Firearms and Offensive Weapons Act, 1990.
The third charge relates to intentionally or recklessly caused serious harm to Declan Wallace, Contrary to Section 4 of the Non-Fatal Offences Against the Person Act, 1997.
The penalties, upon conviction on indictment, carries a maximum term of life in prison. All three also stand accused of producing a baseball bat during the course of the same incident.
The court heard previously how the injured man was left in a critical condition in the intensive care unit of Dublin's Beaumont Hospital after he was allegedly violently assaulted with a steel baseball bat following an earlier verbal altercation.
The two Maughan siblings had initially been denied bail and remanded in custody following a contested hearing at Cavan District Court three days later. They subsequently were granted High Court bail subject to a raft of conditions almost three weeks later.
Today at Monaghan District Court a book of evidence was served on all three accused and they now have been sent forward for trial at Monaghan Circuit Court on Jan 13th 2026.
Before Judge Derek Cooney, they were all remanded on continuing bail to appear for their trial date in Monaghan.
Judge Cooney sanctioned all the accused with free legal aid and allowed for an extra member of council due to what he said was the significance of the charges they face.
