Undue leniency in Clones crash case 'difficult to argue' - Cavan Barrister

Bailieborough based criminal barrister, Séamus Clarke, told the Joe Finnegan Show this morning that since 10 years was the maximum possible sentence, it will be difficult for the DPP to build an argument that it was unduly lenient.

A Cavan barrister who specialises in criminal law believes it would be difficult to argue that the sentence handed down to Anthony McGinn was unduly lenient.

Mr McGinn, with an address at Drumloo, Newbliss, Co.Monaghan was jailed for 7 years last week for dangerous driving causing the deaths of 17 year old Kiea McCann and 16 year old Dlava Mohammed.

He also pleaded guilty to dangerous driving causing serious bodily harm to Avin Mohammed on the same occasion.

Mr McGinn hit a tree at 121.5kph on the N54 at Legnakelly, where the speed limit is 80kph.

The McCann family have urged the DPP to revisit the case, saying that no justice was served and the sentence is too lenient.
